More and more foreigners are buying houses in Spain. Over the past year, more than 61,000 transactions were carried out according to data from the Registradores, which represents 13 transactions out of 100 and is the highest figure in history.

They say that, although most foreign buyers take out mortgages in their country of origin, many find it interesting to know how the supply of loans for the purchase of houses in Spain is.

But is the nationality of the client so important to a financial institution? The answer is yes. In general, banks distinguish the nationality of the person who will take a mortgage in order to apply more flexible or more restrictive requirements.

For example, Spaniards living abroad tend to have the same conditions as residents, even if in the case of foreigners, this has an influence on whether they have family in Spain or worldwide. '' where they come from: if they come from rich countries (Western Europe, USA, Canada, etc.), the entities are more receptive to granting loans for the purchase of housing, whereas if their origin is in Less developed countries or Eastern Europe, the financial sector tends to be more problematic.

"Among the reasons that lead the financial sector to select certain nationalities against others, is the better knowledge of their legal system, economic stability, as well as the requirements of regulatory compliance and money laundering, which which obliges banks to filter customers and ensure that the savings they bring to the purchase come from legal activities (work, investments, inheritances ...) ",

In addition, as Fernando Montenegro, managing director of Legal Lifeline, a legal consultancy firm specializing in the Anglo-Saxon community, points out, "not all banks grant mortgages to non-residents. The main reason is that "It is often impossible to seize assets abroad, so the asset itself is the only guarantee that the bank has when it comes to covering the borrowed money."

According to the information provided by the design office, it is the British and German nationalities who have this offer for this type of mortgage (coinciding with those who buy more properties in their country of origin), although buyers other countries are also eligible for these loans.

In any event, the biggest obstacle encountered by foreigners who want to obtain a mortgage in Spain to finance the acquisition of a house is generally the amount that banks are willing to lend.

If, under normal conditions, residents opt for 80% of the purchase price of the property (i.e. the client must assume the remaining 20% ​​plus the 10% -12% required for costs and the taxes associated with the transaction), in the case of foreigners, the limit is 70%, although in many operations and, depending on the bank, this percentage is reduced to 60% or even 50%. This means that the client must have the savings to pay for about half of the house plus the corresponding expenses.

However, there are banks which see a loophole in the granting of mortgages for foreigners and which create teams specialized in this type of clientele, where they include consultancy work so that they have the guarantee of the notarial process and of the land register.

Once the bank has received the customer's request, the process is the same regardless of nationality.

The risk committee must review all the documentation and accept or reject the credit (which takes an average of one week). If the result is favorable, the institution will send the client a firm offer containing all the financial conditions of the contract which must be accepted by the client within a specified period (generally around 10 days). Once the client accepts the offer, the bank sends all the documentation to the notary to prepare the deed, a document that the user must examine before signing it definitively. It is customary to sign the mortgage and purchase the property on the same day.

Among the most proactive institutions when granting mortgage loans to foreigners are Banco Santander, Ibercaja, Bankinter, Hipotecas.com, Abanca and Bankia. Some of them already have specific services for operations with foreigners, while others are betting on this new niche because of their strong presence abroad or on the Spanish coast, where most of the transactions. Santander, for example, has a strong presence in the United Kingdom, Poland, Portugal, Mexico, Brazil, Chile and Argentina, while Bankia, which has just completed integration of BMN, strengthened its presence in the Mediterranean area.

According to the clerks, the coast and the islands are the regions with the most purchases, since the houses are generally second homes to enjoy the holidays. The most common customers are usually British, French, German, Belgian and Swedish, while the most requested provinces are Tenerife, Alicante, Baleares, Girona and Malaga in 2019. In all cases, foreigners have signed more than 30% of operations.
